1) Who we are & where we practice

Living Optimally provides psychotherapy and related services delivered by licensed clinicians. Clinical services are available to clients physically located in New Jersey, New York, and Connecticut at the time of service. In-person appointments are currently offered in Rutherford, New Jersey; telehealth is available to eligible clients located in NJ/NY/CT.

  • You may see references to “parenting support,” “individual therapy,” “couples therapy,” “family therapy,” and “groups.” Actual eligibility, scheduling, and clinician assignment are finalized through our intake process and client portal (TherapyNotes®).

2) No emergency services; crisis resources

This website and our electronic communications are not monitored for emergencies. If you are in crisis or considering self-harm, call 988 (Suicide & Crisis Lifeline) or 911, or go to the nearest emergency room.

3) Informational content, not medical advice

Website content (articles, downloads, blog posts, emails, social media) is for general education only and does not establish a therapist–client relationship, diagnosis, or treatment plan. Do not rely on site content as a substitute for individualized clinical care.

4) Establishing care & use of the client portal

A therapist–client relationship is formed only after:

(a) we confirm we can ethically and legally treat you in the relevant jurisdiction,

(b) you complete intake/consent forms, and

(c) a clinician accepts you into care and schedules a session.

Scheduling, forms, messaging, and payments may be managed through a third-party platform (currently TherapyNotes®). Third-party terms and privacy policies apply in addition to ours.

5) Telehealth terms (summary)

Telehealth sessions are delivered via a HIPAA-aligned platform. By using telehealth, you acknowledge potential risks (e.g., rare service interruptions) and agree to: (i) participate from a private location in NJ/NY/CT; (ii) not to record sessions without written consent; (iii) keep your device/software updated. Full telehealth informed consent is provided in the client portal and governs.

6) Insurance, fees, and Good Faith Estimates

  • New Jersey insurance: In-network with Horizon BCBS, Cigna, UnitedHealthcare, and TRICARE for eligible plans. You are responsible for copays/coinsurance/deductibles determined by your plan.

  • New York & Connecticut: Generally out-of-network. If your plan offers OON benefits, we can provide a superbill; reimbursement is between you and your insurer and not guaranteed.

  • Self-pay: Current rates are posted on our Rates & Insurance page and may change with notice.

  • Good Faith Estimate: If you are uninsured or self-pay, you are entitled to a Good Faith Estimate of expected charges under the federal No Surprises Act. Request one anytime.

7) Payments, cancellations, and late/no-show

Unless otherwise noted, payment is due at the time of service. You authorize us to securely store a payment method and to charge for scheduled services, including late-cancel or no-show fees according to the policy confirmed during intake. If you need to cancel or reschedule, please do so within the stated window (e.g., 24 hours) to avoid fees.

8) Group services & workshops

Group participants agree to protect one another’s privacy. While we set expectations and discourage recording or disclosure, we cannot guarantee other participants will maintain confidentiality outside the group. Group enrollment, size limits, fees, and schedules are listed on the site and finalized at registration.

9) Communications & privacy (HIPAA note)

Do not include sensitive health information in website forms or regular email/text. Electronic communications may not be fully secure outside the client portal. Our Privacy Policy explains how we handle personal information and HIPAA-protected health information (PHI). By using the site, you consent to the practices described there.

10) Marketing emails & SMS

If you subscribe to updates, you consent to receive emails and/or texts from us. Message/data rates may apply. You can unsubscribe using the links provided or reply STOP for SMS. Unsubscribing from marketing does not affect appointment reminders or legally required notices.

11) Intellectual property

All site content (text, graphics, logos, photos, downloads) is owned by Living Optimally or used with permission. You may not copy, modify, distribute, or create derivative works without our written consent. We grant a limited, revocable license to view and download content for personal, non-commercial use only.

12) Acceptable use

You agree not to: (i) attempt to gain unauthorized access to our systems, (ii) upload malware, (iii) scrape or harvest content, (iv) infringe intellectual property, (v) harass or harm others, or (vi) use the site in violation of laws or professional ethics.

13) Third-party links & tools

The site may link to external websites, booking platforms, file hosts, or payment processors. We do not control these services and are not responsible for their content, availability, security, or practices.

14) Testimonials & results

Client stories or testimonials may reflect individual experiences; results vary and are not guaranteed. We may edit testimonials for length/clarity and remove identifying details to protect privacy.

15) Accessibility

We aim to provide an accessible experience consistent with recognized guidelines. If you encounter a barrier, please contact us at info@livingoptimallytherapy.com so we can help and improve the site.

16) Disclaimers; limitation of liability

The site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Living Optimally and its clinicians will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or reliance on site content. For clinical services, the terms of your signed consent and state law control.

17) Indemnification

You agree to indemnify and hold Living Optimally, its owners, and clinicians harmless from claims, damages, or expenses arising from your misuse of the site or violation of these Terms.

18) Children’s online privacy

This site is intended for users 13+. Clinical services for minors require parent/guardian consent and are governed by intake documentation and applicable law.

19) Changes to the site or Terms

We may update the site and these Terms at any time. Updates become effective upon posting with a revised “Effective date.” Continued use of the site means you accept the updated Terms.

20) Governing law & venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflicts-of-law rules. Courts located in Bergen County, New Jersey shall have exclusive jurisdiction and venue for disputes related to site use (clinical disputes may be governed by separate consent forms or mandatory policies).

21) Severability & entire agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and your signed clinical consents (if you become a client), constitute the entire agreement regarding site use.
